1. Applicability
The below terms of business are applicable for the business relationship between Mittler Report Verlag GmbH and the customer. Unless other agreements are made the general statutory regulations apply.
2. Contract
The „Catalogue“ / „Online Shop“ of Mittler Report Verlag GmbH does not constitute a binding offer. The order by the customer is the basis for a contract with Mittler Report Verlag GmbH, provided it is confirmed by the publishing house. Orders are confirmed by a separate order confirmation or by the delivery of the item ordered. Upon payment of the purchase price the customer acquires property of the item ordered.
3. Delivery Time
Each order is processed immediately upon receipt. Delivery can be expected within 10 working days (Germany), 15 working days (EU). In case that the item ordered is no longer available, the customer is informed accordingly. Should, in this case, the purchase price have already been paid, the customer is reimbursed in the full amount.
4. Shipping and Payment Terms
No consignment can be sent to POBs or poste restante.
The purchase price has to be paid upon delivery.
Up to an order volume of €75.00 shipping costs are charged according to the weight of the consignment.

< 500g: €2.20
501g to 1,000g: €2.90
> 1,000g: €3.90
No shipping costs are charged for orders valued higher than €75.00.
5. Privacy
All customer data and information required to process the order as well as the order confirmation which includes information on the item ordered and the purchase price are only saved by Mittler Report Verlag GmbH for own business purposes and will not be forwarded to any third parties.
6. Right to Return
For all items delivered by Mittler Report Verlag GmbH the customer has the right to return. For sealed data loggers (CD-ROM) this right only applies if the data logger is returned in the original sealed condition. The right to return can be executed without explanation within 14 days from the receipt of the respective consignment to the following address: Mittler Report Verlag GmbH, Baunscheidtstr. 11, 53113 Bonn, Germany. The costs for the return shipment have to be borne by the customer if the items delivered correspond with the order. In case that the use of the item by the customer has resulted in a decrease in value or if the item can only be returned in part, respective compensation can be claimed by Mittler Report Verlag GmbH.
7. Right of Withdrawal
The client has the right to withdraw from his order within 14 days and without explanation.
Withdrawal is to be announced in writing (letter, fax, email) or by returning the item ordered. The withdrawal has to be addressed to: Mittler Report Verlag GmbH, Beethovenallee 21, 53173 Bonn, Germany, fax: +49 228-35008-71, email: info@mittler-report.de. To withdraw customers can download the withdrawal form offered on the Online Shop website which, however, is not mandatory. In case of a withdrawal the services rendered by either party are to be returned. Shipping costs for returned items are to be borne by the customer if the item delivered corresponds with the item ordered. Withdrawal has to be notified to Mittler Report Verlag within 14 days from the receipt of the item ordered.
In case of a withdrawal all payments received by us, including shipping costs (except surcharges arising from the selection of a shipping option other than the suggested most economic variant) shall be returned within 14 days from the day the notification of withdrawal is received. To return the payment we will use the same means of payment as used by the customer, provided no other agreement is in place. In no way does the return of the payment incur any surcharges for the customer. Return of payment can be held back until the product(s) has/have been returned or the customer has provided respective proof. In any case, the consignment with the product(s) to be returned has to be dispatched within 14 days of the notification of withdrawal. Shipping costs for the return of the product(s) are borne by us. A potential decrease of value of the product(s) has only to be compensated for by the customer if it is the result of inappropriate use.
8. Reservation of Proprietary Rights
The item ordered remains to be the property of Mittler Report Verlag GmbH until it has fully been paid. The first reminder does not imply any charges for the customer. There are charges to the customer for the second reminder, and the third reminder may be issued with the support of a collection agency.
9. Place of Jurisdiction
The City of Bonn, Germany, is the only competent court of jurisdiction for any issues arising from contracts that are based on these terms of business.
10. Final Regulations
This agreement and all terms and conditions of all transactions hereunder shall be governed by and construed with the laws of the Federal Republic of Germany. The application of UN sale of goods law is excluded
Should individual clauses of these Terms of Business be or become invalid they do not influence the nature of the contract or other clauses valid under the scope of these Terms of Business. Invalid clauses are replaced by valid clauses which best comply with the economioc sense and purpose of the clause that is or has become invalid. The same applies to missing regulations.
